Previous employer not releasing salary eventhough notice period was survived
Dear all my husband was working with mercedez benz autohangar section for about 2 years. he has been the best performer there in the sales and had been independently handling the preowned car section. he then got a better offer as the salary increment was not as per his expectations. he informed his immediate supervisor about the good opportunity and asked if 15 days notice period would be enough if he needs to leave the company on good terms. the supervisor agreed. he made a smooth handover of duties till the last date of the notice period and also kept sending mail reminders to supervisor asking for any issue which required his attention before he leaves. he got no replies to the same. after he left and joined another company his supervisor at mercedez benz autohangar section started coming up with all different issues which were held back due to delay from workshop or customer dissatisfaction due to the same wherein he has already contacted the customer and he doesnt wish to cooperate with the organisation due to delay caused. according to me the management should understand that we have no control on the customer satisfaction index and no one can be punished for the same. the mercedez benz autohangar section has held back his salary for the month of august 2011 and his incentives for june july august which round up to about 1 lac rupees. and i am getting the impression that the organisation is trying to give him reasons just to avoid paying him. need your valuable advise as my husband is going through a horrible emotional and mental turmoil due to the financial problems caused as he hasnt yet received the salary from the current company too. please advise : rebecca tanna
Is it compulsory to give notice period to employer
Respected sir my employer not giving my salary on time since last 23 years. salary getting once in a two month now december salary is pending and company not releasing my lta from the period 2008 to till date. it is part of my salary deducting equal monthly amount. if i resign is it necessary to give notice period of two months they have mentioned in my appointment letter? also please confirm me the calculation of gratuity period?
Employer sent me a legal notice to compensate 21000 gross salary - was on probation period of 3 months
Dear team i have served 7 days notice period but the previous employer said you have to serve a complete 1month notice period as i was there on a probation period of 3 month so now they sent me a legal notice to compensate 21000 gross salary but i have not given the previous employer details to with current employer so is there any issue or how can i respond to previous employer as i can t serve 1 month notice period and pay 21000 gross salary. so is there impact will be on my career as in pf also they have marked exit so if my current employer may ask about the legal notice or not as i have not given previous employer details to my current employer so pls help on this asap...as they are harrassing over call or mentally torture you have to pay 21000 or serve 1 month notice period so pls help
Company not releasing my previous dues
I was working as a content writer with a private travel firm. after working their for over one year i resigned from the company mostly because of the delay in salary. i submitted my resignation and agree to serve one month notice period. during notice period i serve for only 1 week and went for a leave of 10 days and after that i did not returned for the work. now i am asking for my 15 day dues which the company is not releasing...furthermore the company does not deduct any pf after being a possessing a workforce of more than 12 people. pleas guide me what should i do..
No salary after resignment for notice period
Subject no salary during notice period i have resigned from my previous employer and given 1 month notice period for relieving. but management relieved me immediately as my nature of job is of highly confedential in nature. now the company is not paying me the salary during my notice period . kindly advice whether i am eligible for salary during my notice period or not and what action further i can do.
Employer not accepting resignation and not releasing even after serving notice period
I have a notice period of 1 month with my current employer us based startup started in india sometime back and i have resigned from my company and expecting to get released by next 1 month after serving due 1 month notice period. my employer is not accepting my resignation and also not stating my final release date . i checked the offer letter and see that one of the clauses of termination is that "notwithstanding anything aforesaid termination by you shall be subject to the satisfactory completion of all your existing duties obligations and projects. my question is can the company delay the acceptance of my resignation and my subsequent release using the above clause.?? can i seek legal recourse against the company for not releasing me even after serving notice period. what should i do??
