Pf & esi applicability for contract workers
Hi in a restaurant the cleaning work has been given to a contractor. the contractor has employed 7 employees the contractor has only 7 employees working for him for the work. will the 7 employees of the contractor come under the pf and esi coverage? if they do who will be liable to pay the restaurant or contractor as the restaurant makes a monthly payment to the contractor? the restaurant has 15 permanent staffchefwaiteraccountant manager etc. apart from the 15 staff there are the 7 employees provided by the contractor total 22 employees. as there are only 15 permanent staff will these come under pf and esi coverage as it is below the 20 employees requirement for pf and esi? thanks in advance for the help.

Dear sir i am running a business which started with 6 employees but now it has grown to 13 permanent staff and 15 temporary staff. is pf and esi should be covered?. if so for esi coverage how many employees should be there and for pf how many employees?.will permanent staff is only covered under pf and esi? gross salary for esi and pf coverage? age factor has to be considered for coverage of the employees? one of my well wisher gave me the following details: employer contribution pf12 or max rs.780 of basic whichever is lesser pf 8.33employees family pension fund 3.67employees pf 0.50 of basic or maximum up to rs.6500 admin charges1.10 of basic inspection 0.01 of basic employee contribution 12 of basic for pf esi employer 4.75 of basic employees 1.75 of basic temporary staff often leave the job who are not stable.kindly note it. kindly advise me thanks and regards dhanasekar

Esi coverage in areas which do not have any esi infrastructure
I m working with a large manufacturing company in orissa. the company is exempted for esi in respect of regular employees. for contract workers we have a system of providing coverage through a workmen compensation policy and has a dispensary to take care of their immediate health needs. the company is located at a place which does not come under the municiple limit of the nearest town and is in a village. the town has a small & insufficient setup of esi infrastructure in such a situation is it necessary to have esi registeration for contract workers or esi registeration is must with or without esi infrastructure. friends please help regards arvind tiwari orissa

Dear sir regarding the coverage of esi i have the following doubt. some of the contract workers are working in our industry on piece rate and all these are covered under esi. most of these people and most of the times they are earning more than rs. 15000/ per month including overtime. they are requesting to bring them out of the coverage of esi. i informed to my boss that all these people should have fixed wage which should be more than rs. 15000/ then only we can bring them out of the coverage. but he is having opinion that since these people are drawing more on most of the times they can brought out of the coverage. what can we do? kindly clarify giri
