Dear Ravi

Disciplinary action can be initiated for an act which violates the rules of discipline. In Standing orders Act 1946 ( Model standing orders ) the misconducts are specified. If any employee involved in any of the misconduct the disciplinart action can be taken. There are stages of disciplinary action/Punishment provided in Standing Orders Act 1946 a) Warning 2) fine in accordance with The payment of Wages Act 1948 3) Censure 4) Suspension ( Max 4 days 5) Termination/Dismissal. If any employee involved in misconduct like say late coming- then the warning letter can be issued. If no improvement is observed then second warning may be issued. In the third time you may issue him show cause obtain his explanation. If he refuse the charges of late coming then issue charge sheet & conduct enquiry. Take report & suspend him 1 or max 4 days. In the naxt stage if no improvement is seen then again you will have conduct to conduct the domastic enquiry & after obtaining report from enquiry officer you can terminate the employee. .While deciding the punishment after legal & fair domastic enquiry you have to remember the principle " The punishment should be inproportionate with the gravity of miscinduct " For Warning notice, Show cause notice, charge sheet, enquiry notice, second show cause, termination notice etc. formats, you may contact me
