HI,
Iam working as an HR ,i have come across an employee who is giving fake expereince certificates of our company to other people and charging from them.Now I am planning to terminate him on fake exereince grounds.Can anyone please help in writing termination letter mentioning this issue .
Its very urgent.

The grounds on which you wish to terminate him will be Criminal--NOT just rules-related or 'fake experience' related, like you mentioned.
Based on what you mentioned, he didn't get the job in your company using fake exp certificates [which is what will attract action on the grounds you mentioned]--he was indulging in acts of criminal breach of trust--misusing the office facilities & his position against the general norms/rules of any company.
In fact, you wouldn't be wrong even if you lodged a Police Complaint, assuming you have all the proofs/evidence in hand.

Dear Prananvi,
This is a serious misconduct and violation of code of conduct. If an employee has no express authority then he/she cannot issue experience certificate on behalf of the company.
You may suspend immediately and initiate disciplinary proceeding against him. Hope this may help you.

Dear Sir/Madam,

You did not give the status of employment of person who is giving fake experience certificates to others for earning money. Every organization should have some standing orders / service rules wherein different acts shall have been notified under the head of misconduct. Giving fake service certificates and causing tarnishing the image of organization will constitutes misconduct and person who is said to be commit such act shall be liable for disciplinary action.

Here one problem is there to terminate the services of such employee who is said to be involved in the act which you have quoted as above. If the employee status is trainee or probationer, you can discharge him / her by invoking the relevant clause of appointment order. However, if such employee is confirmed, then we have to follow the issuance of charge sheet, calling his explanation, holding an inquiry if we did not satisfy with his explanation, issuing final show causes notice and termination order etc

Thank you very much for your Replies.He is still under probation period .He is a software engineer.
I want to send him the termination letter first and then call him for explanation ,so how shall i write it ,can you please help me .

It is reported that you are issuing fake experience certificate to outsiders for getting illegal gratification. In this regard, we have received a some of such certificates issued by you from the employers for verification or reference check.(Pl give the description of fake experience certificate and candidates names on whose favor the same were issued)

On scrutiny of the same, it is found that you have issued those certificates without having any authorization to outsiders for getting illegal gratification which amounts to misconduct under rule no........... of the service rules of the organization and the same is liable for server action against you. Thus, your above act of issuing fake experience certificates and cheating the organization is not only constitute misconduct under service rules but also liable for taking an appropriate criminal action under Cr PC in the court of law.

In view of the above, we felt that it is not advisable for us to keep an employee who is not fair and having the criminal intent to deceive the organization like you any longer and we have decided to terminate you from the services of organization.

Accordingly, you are hereby terminated from your probationer employment in our organization with immediate effect as per clause / appointment order / service rule. However, you will be paid one month notice towards notice period. Therefore, you are hereby advised to handover the company articles taken by you if any including ID card/ Bus Boarding pass etc in the HR Dept within 24 hours of receipt of this order. We have advised the accounts department to settle your account and send the amount due to you if any at the earliest.
