I was working for a limited company in Delhi for the past 2 and half years. I resigned from the company 1 year back. The company deducted 12,000 per month as super annuation. They do not have any tie ups with Pension scheme or LIC and they stopped the super annuation scheme in the company a year before. They informed me that they would return the money. Since I resigned form the company, I was told that I am not eligible to get the super annuation amount. Can you please guide me regarding how could I go about getting this amount back.

Superannuation scheme is a policy of the company and the rules of the same may have a condition that those who leave the company before completion of at least five years of service, will not be eligible to get the amount. That is why the amount is not paid to you. However, if the so called amount was recovered from your salary during your service with the company, you are entitled to get the amount so deducted.

Dear team, as per my knowledge one can withdraw superannuation amt after attaining of 58 yrs only by way of annuities from LIC. If any member wants to withdraw before 58 yrs of age he wi ll get only some portion only and has to forego remaining part. or else he can get it transferred accummulations to similiar fund maintained company only. You can ask your superannusation number from your company and apply in form-A or B. Regards/SVS Rao
