Hi All,
I have been working in IT company for past 3 years. I decided to quit and submitted resignation. As per company policy Notice period is 2 months. I have resigned on 1 July. I never accepted my withdrawal of resignation during discussion with RM. My RM cancelled my resignation saying that: As discussed with employee along with HR. Surprised and dishearten. when asked RM , he says speak with HR. HR told that RM cancelled my resignation due to business reasons.
Frustrated with denial of basic employee right to resign. I have already sent concern mail to RM about reason for cancellation of resignation request, he is not replying.
Please advise, how to proceed further.

Dear Sudhakar,
Did you take a signature from HR or RM on the duplicate copy of the resignation letter in person or via email as a proof of receipt. If so then even if they reject your resig letter, the notice period continues the same.

Hi Ashishloyal,
Thanks for your reply. Have mail proof. Tool itself sends automatic mail to HR and RM. Please advise how to proceed further. They threatening with termination if did not hear to them. Please let me know governing law for IT employees also what are the options available for justice.

forward that email to companys main email ID also that will be a valid proof even your Rm excuses i had never received such mail then show that copy also.dont worry after two months u will be releavd

Dear Sudhakar,
As Ashish told, if ur RM had acknowledged the copy of ur resignation or any automated mail receipt is enough for ur release. Dont worry. In case of threatening, contact Ministry of Labour.

Need not to worry. They can only threaten nothing beyond. Try to document all correspondence in all forms. In extreme case you may refer to Labour Commissioner’s Office.
