Dear All,
If a highly skilled employee ( to the cadre of CA) working in organization on full time basis and availing all prevelaint benefits wants to do his profession of retainership basis (e.g CA who wants to work for company not on rolls but on retainership basis) can he be provided with other benefits of company simultaneously like leaves, tour slabs etc or the benefits availed by him be withdrawn in such case ?
also in such case how should one proceed like salary would be ceased and and he would be provided with consultation fees. How should one proceed in such case . Is any deed required too to be done with him and if yes what should be proforma of sucj deed?

Dear Kartiken,
On retainership your status would be a consultant and liable to produce the bill for the consultation on month basis. Your company will deduct TDS for the professional services rendered; I believe you might be well aware of it.
Normally the benefits like the leaves/travelling and others are not available. You company may allow you the reimbursement part on a case to case basis.
You are right that an agreement would be required comprising the below facts:
1. Term
2. Consultation fees
3. Ways of payment/invoicing/TDS others
4. Scope of services
5. Termination of contract
6. Miscellaneous clauses/renewal terms
