Payment of bonus act-basic or gross salary??
There has been an amendment in payment of bonus act by an ordinance issued in 2007 which mandates an organisation to give bonus to employees drawing wages or salary upto rs. 10000. 1 please let me know if the 'wages' or 'salary' reffered to in the act means basic salary or gross salary. 2 my friend is having a problem in getting his bonus because his company is saying the act refers to gross salaryand his is greater than 10000 while i have seen companies handing out bonus on basic salary. 3 is there any govt. document my friend can show to his company to show that the act refers to basic salary.what can he do? please guide.

I have an query i work in public sector. in my plant we have few employees whose gross salary is lower than 15000. ie they fall in the purview of esi remaining employees are out of the coverage as they have higher salary. now the problem is suppose the gross salary of an employee is 14000 now we pay for his esi contribution as per esi act.but after wage revision in may month his salary increases to 18000. now automatically he gets out of coverage but as per law we will contribute till the end of the contributory period ie october. nowdue to absenteeism the employee withdraws a gross of 14000 in the month of july and net pay around 13500. . now will this employee come back in the purview of esi as his salary gets lower than 15k???. will this monthly change in salary due to absenteeism will come into effect? my question is once the gross crosses 15k can the employee again return under esi if the salary for any respective month falls below 15k if he is absent??? please give me the section where it is written in esi act. 2. another case is... we pay statutory bonus 8.33 at the month of oct. now all the employees have basic da around 25k . so naturally they will not come under bonus act as basic da is higher than 10k. now suppose for any month an employee comes for 5 days in a month due to sickness or domestic problem and he withdraws a salary of 9k will i have to pay him bonus for those months? bonus in our plant is paid annually ie 8.33350012 so if someone withdraws less salary for any month will he come into bonus act??? which section defines it can any one help..

As mentioned the forum bonus can be paid on monthly basis and it can be part of ctc. now my querry is that for calculation of eligibility under esi the bonus so paid on monthly basis should be treated as esi salary. further do we have to pay esi on bonus so paid as well for the employees who are covered under the.esi act? hope i am clear. thanks subhash arora

Bonus & epf,esi,salary structure
Dear all the statutery percentage of bonus starts with 8.33 and maximum is 20. my questions are 1. if my company wishes to give bonus of >20 what is the legal position with respect to it. 2. can the company fix slabs of bonus for different range of basic pays. eg. all employees getting below 5000 basic20000/ as bonus from 500110000 30000/as bonus above 1000035000/as bonus if the employees has no objection for this can the thecompany impliment this. what is the legal position. 3. if salary structure is the prerogative of the company it can fix the 10000/ salary with a basic of 1000/. whci effects pf outgo. this is of particular importance as some employees getting lower salary are showing resiatance to pf & esi. 4. is bonus production bonus rewards etc also added for the calculation of pf & esi. as cost of living increased the employees at the lower slary slab are the ones who are getting most affected. i am only trying to figure out the ways to find less outgo for the company and employee and the employee should get the same or more salary pocket as the company benifits from the saving in employers share it can pass on some part of it.. but how the law at hope getting reply.
Calculation of bonus
Dear all please give solution for below 1 salary of employee is 10000/ his basic is 4000/ so as per act bonus will calculate on 3500 or 4000? 2 salary of employee is 20000/ his basic is 8000/ so as per bonus act his basic is less than 10000 so is he eligible for bonus? in both cases employee has completed 30 days service thanks
