Hi Sr
I have a query(s) related to maternity leave. Pls reply keeping legal as well general HR practices in mind:
1. The salary company is liable to pay during maternity leave is of total salary or basic salary only?
2. How a company can assure that women will rejoin after maternity leave period is over and not resign. I mean is there is any way out that company can assure that women will return to work after the break and not continue. Can we pay her maternity breaks dues after her rejoining the duty?
I am asking this question because one of our employees went on maternity leave and she was suppos eto join back on 15 May but when she joined back she resigned the next day saying she is finding it difficult to manage and may go for longer break after getting relived from the company? Pls give your comments on what company should do in this case as company has given her free 3 mth salary to cover maternity.

Reshma,
Whether she rejoins or not, it is the statutory requirement to pay her the last drawn salary/wages during her maternity leave if she completed 80 days during the preceding 12 months from the date of delivery.

Its a statutory requirement so company has to adhere to this practice........though there are ways to ensure that they wuould come back.....
# Speak to the lady when she is on maternity leaves, generally its been observed that people do not communicate much with ladies during maternity...
# Keep sending them mails..updates on what is happening in their department and organisation, keep them involved in important decision making related to their department and role....
# know about her family....who all are there??..offer counselling...it surely makes an impact...
# Be clear about their role in organisation and career growth path....its a key to keep them motivated about their professional life...
# Also accept the fact that this period is special for every woman..so in case they want to extend their leaves by one or two months..the option should be kept open after proper counseling.............
