Hi,
I was working with an organisation, and i resigned the company without any prior notice period. I mailed the resignation letter to HR head and the Dept Head from my private mail ID. And because of that they didnot pay me my salary for that complete month.
And now when my new organisation called them for verification, they replied saying that I was blacklisted in their company.
Now i have a copy of the resignation letter and was also not been payed the salary for that moth. Can anyone guide me how to get out of this situation.

Dear Deeziner,
I am just sharing my views, this is your fault. Without serving notice period how can you expect your salary and wish from your previous employer. Follow some ethics it will help you to become good professional. You just think management or hr point of view, assume that you are a hr person will you accept if any one of your employee relieve without notice period? will you pay salary? will you refer him for new job? No one will do..........even i will also do the same but only thing i will not give any negative comments on employee but i can tell them the real fact.........

Basically what was the reason that you quitted the job without serving the notice period??What was the urgency for the same then may be one is able to advise you to how to sort it out??

Hi.......
I think in first place not giving proper notice to management is a grave mistake on your part and company has all the right to repay you like this.
How could one just resign thru personal ID and expect to be treated fairly. I think you should take serious lesson from this episode and preferably go an apologise to the previous management and request them to review their opinion about you so that you dont face this problem again with new employers.

Hi Deeziner,
Try to sort out the problem instead of going against your previous management.
- Read all the employment letters from your previous employer, which might help you with a solution some where
- Talk to your previous management
- Accept and apologise
- Explain the urgency under which circumstances you have quit your job
- Offer yor help if they still require it (Dont argue)
- Check if you can pay for the notice period
try these things, may be others can add some more..

Myself & my wife were working in same organization as a Level II Technician. We both were performing well in our process.

One day our manager called us & told us that one of us should leave the company as per the company policy. So, I agreed to leave the job while serving notice period I got an offer from different company & got F & F from the company along with relieving letter.

After I left they have started creating problem to my wife saying she is taking many leaves & which is affecting the process.

One day her Manager called her to resign from her duty immediately. When she asked the reason they said, she is taking many leaves which is affecting the process.

They don’t want her to serve notice & forced her to resign from the duty. My wife told them she will serve notice period in order to get all the incentive & bonus from company however they don’t want her to serve notice. So, she gave the resignation letter & came out of the office.

Now, after 5 month they sent her an email stating, she has to pay some 21000 to company as she didn’t serve notice period.

We don’t know why they sent her email after 5 months. Is that the warning letter, is there any way they can take legal action on her or shall we take any legal action on company.

Hi Mahesh,
Please check the following things which might help you out :-
- Read all the employment terms in the appointment letter which might help you to remember the separation terms
- Is there any formal mail or written document given to your wife about the amount to be paid in lieu of notice period earlier,If not,you have a point of adavantage
- Once your wife have given resignation, are all the terms of agreement b/w the managmnt and your wife are recorded?
- Is there any formal mail from the co: to negotiate the notice period issue to be settled in these five months, If not they cannot ask all of sudden to pay.
- Is the full and final settlement done along with the relieving letters? If yes, they cannot claim for the same.
