Hi,
I am planning to establish the Intellectual Property Management process in our organization. Also am auditing the current condition of this process.
1. Do we have any Industry standards which can be used to do this audit.
2. Does anyone have a framework/model of IPMS
3. Is FTO (Freedom To operate) a industry term. If yes, do any one from the (IT industry) have a structured process from this with Metrics around.
4. Are there any external consultants / Auditors available to do a gap analysis of this process.
and many more questions on the Intellectual Property process. But to sstart with please do reply to the above & if you have any documents/standards/checklists please do share.

Your answer to all the questions is yes. Although am not familiar with FTO as a standard term...
I am an IPR consultant myself. It is like setting up a new mechanism like performance appraisal. So, you can guess the complexity of the process. What is your specific need? We can help you professionally. However, I am sure your company might have a legal counsel (most ltd cos will have one) and you might be better off appointing him as your consultant.

We already have some adhoc process for IP. But we are not sure of the Quality of the process and also not aware whether we are following the process as per any industry standards. So i want to do a audit or gap analysis, to identify some improvement opportunities.
And secondly the cycle time of internal IP process including the FTO clearance is too much. I want to understand are there any benchmarks available in the market mainly for software/technical IP activities.
Due to issues of attrition in this area we are facing these problems. It will be great, if you can share us some information and let us know the industry standards used for IP process.

I guess the attached research might help provide you with some additional perspectives. They do not discuss the specifics you have asked for, but will help you understand the business perspective behind driving the process. We could, of course, discuss it out with you.
To be honest, most companies I have seen have adhoc processes. Hence, I would be surprised to see an industry standard. Of course, there are several guidelines one could use. Very few have IP specialists integrated into their operations (I know Intel is one of them). But as you rightly said, it needs to be audited depending on the business impact expected.
Attrition in this area is not uncommon because of the tricky parameters used in assessment.
