Dear Bala,
ur query is very short and hence can't understand what exactly u wish to know. if ur services has been terminated by any way before 5 years then u r not entitled for gratuity.
if ur service has been ceased after 5 yrs. then only u can file ur claim for gratuity to the controlling authority of ur area under The payment of gratuity act before 2 yrs. u r stating the period is 3 yrs after re-leaving from services if so u have to file request for condolence of delay with proper reasons. then only ur application shall be heard.

Dear Bala
1)Gratuity is an amount given to employees by employer when they leave the job after complating five years or minimum 240 days of per year of after retierment. The number of years may differ from company to compny.
2)Gratuity is payable under the payment of wages act
3) Grauity shall be payble to an employee on the termination of his employement after he has rendered continuous service for not less than five years (a) on his superannuation ,or (b) on his retirement or resignation ,or (c)on his death or disablement due to accident or disease
4) gratuity is calculated as Basic +DA divided by 26* No ofyaers of service * 15
