Dear Frnds,
Please share the warning letter.
I want a format for warning letter for an employee who resigned without prior intimation.And as per our our Appointment Letter, we have a one of clause that no employee will leave the organisation before completing 3 yrs of his job.and even not join any other organisation which are having similar interests or same activities related to our org.
Please help for drafting this letter.
we would also add a legal points related to his resignation.

But I need other thing.
actually he resigned with a notice period.But our company rules that no one can resign org before completing his 3 yrs and not join any other orgn in same field.For this how can we treat with him as legallly.

Dear Friends,
An employee in our company joined another company without resigning & proper hand-over of work. I have been asked to prepare a warning letter to this person. Please could anyone help me by giving a format of warning letter in this case.... asking this person to serve the notice period of one month or pay three months salary to the company.

Dear Sonia,
1) Article 19 in The Constitution Of India 1949
19. Protection of certain rights regarding freedom of speech etc
(g) to practise any profession, or to carry on any occupation, trade or business
2) The Indian Contract Act, 1872
27. Agreement in restraint of trade, void
Every agreement by which anyone is restrained from exercising a lawful profession, trade or business of any kind, is to that extent void.
Please read this section/ article hope you can not warn anybody for resignation.
