| | Re: DOES ESIC PAY SALARY OF FEMALE WHO TAKE MATERNITY LEAVE THE ESI ACT IS SOCIAL LEGISLATION PROMOTING THE WELL BEING OF THE BOTH EMPLOYER AND EMPLOYEES. THE EMPLOYERS ARE ABSOLVED FROM THE RESPONSIBILTY WHICH ARE IMPOSED ON HIM UNDER THE METERNITY BENEFITS ACT, 1961 AND WORKMEN'S COMPENSATION ACT, 1923. ON THE OTHER HAND, THE BENEFITS WHICH ACCRUE TO THE EMPLOYEES ARE MANY FOLD. THE ESIC IS HAVING MANY STATE OF ART HOSPITAL SPREAD IN MANY PARTS OF THE COUNTRY AND IS HAVING SUFFICIENT PROVISIONS FOR TREATMENT. IT ALSO PROVIDES FOR COMPENSATION IN CASE AN EMPLOYEE IS NOT ABLE TO ATTEND TO HIS DUTIES. EVEN WHEN AN EMPLOYEE IS TERMINATED IT PROVIDES FOR SOME COMPENSATION ENABLING THE EMPLOYEE TO MAKE BOTH ENDS MEET PENDING FINDING OF A NEW JOB. NAME ANY THING AND IT IS COVRED UNDER THE ESI. IN MY OPINION THERE ARE TWO TYPES OF PROBLEMS WHICH ARE BEING FACED BY THE INSURED.
1. THE PROCEDURAL PROBLEMS I.E. THE INSURED IS NOT MUCH ENLIGHTED ABOUT THE WAY FOR RECEIVING BENEFITS.
2. THE INDIFFERENT ATTITUDE OF THE ESIC AUTHORITIES.
BOTH THESE DIFFICULTIES ARE CAPABLE OF BEING TACKLED. THUS WE CAN SAY THEY IT IS A BEAUTIFUL PIECE OF SOCIAL LEGISLATION

| | Maternity Benefit Act has been enacted to give the leave benefit and sense of security to females. There is need to revamp of our labour laws. Definition in one act differ from the definition from the another act. The create the confusion. |

Merely because ESIC pays it Employer cannot deny benefit under Maternity Benefit Act.There is nothing like unjust enrichment in Welfare Legislation & the benefit goes to the Employee & in this case a woman employee. With Regards V.Sounder Rajan VS Rajan Associates,
