Maternity benefit for employee on probation dear seniors i would like to know if maternity benefit could be given to employee on probabtion. actually one employee has joined us in aug.09 and now she is asking for the maternity benefit is she eligible for the maternity benefit as she is on probation period and she is supposed to take leave during dec.09. according to maternity benefit act : it says a women shall be entitled to maternity benefit only if she has actually worked in an establishment of the employer for a period of not less then eighty days in the twelve months immediately proceeding the date of her expected delivery section52 now here it is mentioned 80 days in the 12 months. seniors pls. guide me with regards deepmala

Hi all this is regarding maternity benefit. i am working in a managment institute affliated to a recognised university. my appointment is ad hoc .i am working there since 2006 aug. i want to know whether i can get the maternity leave as per the maternity benefit act?also my pf deduction can is also being done. can anyone tell me whts the scope of this act and can i fight for the maternity leave is i dont get it

Hi all i ve a query regarding maternity benefit.i joined this company in oct 2010 my probabtion is over & i ve received my confirmation letter. in feb i told my manager about my pregnancy but after that his behaviour towards me changed he says that i m not focused in my work & he wants me to resign.i denied to resign as i said that i m meeting up my kra s & this is not the actual reason. i know that if i will resign i won t be eligible for maternity benefit. please let me know if he terminate me would i be eligible for maternity benefit or not? let me know what maternity benefit act says in this case. regards pragya

As per the new amendment of maternity benefit act one of our female employee request for maternity benefit form march 2018 doj: march 2016 last date of working :07th march 2018 expected date of delivery : 23.09.2018 leave balance : nil designation : executive hr kindly guide me whether she is eligible for maternity benefit as per the new amendment.
Company doesn't have maternity leave benefit
Dear all need few suggestions from all respected knowledgeable person. i ve joined a startup retail company as a hr manager to setup hr department over there. as per the shop & establishment acts and as per the labour laws i am making hr policies. i want to include maternity leave benefit into the hr policies but management is denying to provide maternity benefit to their female employees. my concern is if a female employee become pregnant and worked above 1 year in the company and company does not have maternity leave benefit. can she avail maternity benefit as per the maternity benefit act. kindly guide me on the same. waiting for your valuable feed backs & suggestions. thanks & regards shubhangi shah
Maternity benefit eligibility - paid 50% of the maternity benefit, remaining after rejoining office
Hello all one of our employees was on maternity benefit. we have paid 50 of the maternity benefit and the remaining amount was supposed to release once the employee rejoins the office physically after the maternity period but the said employee did not join and extended her leave for 06 months after expiring extended leave she still not joined and continued as work from home with 50 salary and never joined the office. recently she has resigned now the management has decided to pay only 50 remaining maternity benefit as she did not join the office. so shall we give her full maternity benefit as per act or can we deduct some amount? please guide.
