Contractor a who is principal contractor has outsourced job to subcontractor b. form 5 is in the name of contractor a and labour license has been taken by contractor a. however pf deduction is being done by subcontractor b in his pf code. is it valid as per law???

Hello to all dear friends i have joined this fourm to day and it is realy good fourm for hr professionals. my quarry is regarding the contractor. if a contractor has awarded work which was originally awarded to him to another party/contractor then whose name should appear in the register of contractors to be maintained by principal employeer? also the liabilities as in respect of pf deduction and submission to pf authorities will be done by the original contractor or the second party? regards kdpaliwal

Dear seniors we had engaged a contractor for construction work and accordingly entered in to agreement. but due to default on the contractor s side as per the terms and conditions of agreement the main contractor sublet the work to sub contractor with our permission. now as we have no direct connection with sub contractor and right now all the labour which is working is of sub contractor. the problem is arising here that bills are being submitted by main contractor but all the statutory compliance i.e. epf employees compensation etc. are being complied by sub contractor. my question here is that whether we can accept this or main contractor has to take all the workers working under sub contractor under his rolls. please clarify regards ashwini

Hi all greetings for the upcoming diwali need some inputs on labour licence issue... actually our organization has engaged a contractor a for a big technical job. this contractor a has further engaged a subcontractor b for supply of manpower for the said job. now in such a case to whom we should issue form v to our contractora or to his subcontractorb or to both. as as per clra act even a subcontractor engaged in the establishment is a contractor . there is a view that the contractor should get a registeration certificate for proposed engagement of contract worker directly of indirectly and then he should issue form v to his contractor i.e. subcontractorb. please help as it is urgent regards arvind tiwari paradeep

Dear sir we have started a new business in june 12 and have approx 85 labours out of which 20 are regular for production and remaining are for cleaning and maintenance. all the labour are thru contractor. the factory is in surat. the labour is not interested to have any deduction of account of pf and esi and they want rs 300 as takehome daily wages. so far the contractor has just paid the wages to the labours and charged to us with his commission. there is no compliance so far. more so being a small contractor he is not aware of what all compliance he has to make. i being the production in charge is much worried. the management has even approved to pay the cost of compliance to the contractor but we both contractor and myself are not aware how to work out the total compliance cost i.e. pf esi paid leave etc. apart from pf and esi there are many other compliances to be made wounder how to convert these into amount. request seniors to please mail me calculation considering 2 workers who are being paid daily wages of rs. 300/. please suggest the agreement format we should have with the contractor.
