Dear All,
I working in a software service indian based Pvt limited company. From the date of joining till date, Employer never revealed gratuity benefits in my offer letter or apprecial letter for 4 years nor deducted for it but they deducting PF. Now im going to complete 5 years of experience company. As per the rule , if pvt ltd company has more that 10 employees . Pvt limited company is mandate to give gratuity to the 5 years completed employees.
My doubt is ,Till this pvt limited company declares officially . then only it will be applicable or basically Pvt limited companies should grant gratuity benefits.
Pls clear my doubt .

Whether company will not disclose/declare/revealed about the payment of gratuity its a statutory benefit acrue to an employee, at the time of leaving the organisation after complextion of 5 years. No deduction required.
