Pf & esi exemption - for employees
Dear all we have engaged a service provider a chartered accountant for audit activities. the agreement is between our company & the m/s. xyz & co. chartered accountant s firm. the chartered accountant has hired 2 employees from a different company third party & has made them operate from our premises for audit activities. the chartered accountant claims that those 2 employees are exempted from pf & esi since their salary is more than rs. 10000/ & hence he is not deducting pf & esi for these 2 employees. request clarification for the following points : 1. what is the criteria for esi & pf exemption conditions 2. if exempted as claimed by the chartered accountant what documents can we ask him to submit from hr statutory compliance viewpoint? 3. we are in no connection with the third party from whom the ca has hired those 2 employees but the ca is submitting the copies of the third party pf & esi challans attendance register wage register. what needs to be done in this regard. kindly request you to provide details w.r.t. the above issue in detail. thanks & regards vadiraj kulkarni

Dear all our s is small company with 30 employees and we are into manufacturing based in chennai.we want to outsource our payroll.it includes payroll calculation returns filing & maintaing of registers & records as per applicable labour laws. how much we can pay to a third party consultants? can we enforce him to represent the company during inspections etc regards rao
Esi & pf applicability
& to esi & pf to all esi & pf becomes applicable to all employees irrespective of their designations or whether they have been taken on a probationary basis/ on a contract basis individual or either through a labour supplier /on a daily basis/ on a weekly basis wherein their total emoluments is rs.7500/pm for esi and rs.6500/ for pf they are ought to be covered under the act. as per the latest court judgement esi department is insisting the employer to deduct contribution on parties doing job work either inside the premises of the factory/establishment or outside at the party s premises. before the employer by providing supporting documents didnot deduct esi for the parties who had done work outside the premises since the party were different entities and dont do the work exclusively for them alone.this was proved by providing sales invoicesdelivery challans proving that the materials were sent out and no workmen were engaged by the principal employer to do the work. however after this debatable judgement the employer was told to deduct esi for job work since the principal employer has the discretionary powers to reject the material wherein supervisory control is there over the party on this basis the employer is been asked to deduct from the labour bill 6.50 and pay this amount vide a separate challan. in case the party has an separate esi code no. he may be asked to provide the copy of the paid challan along with the returns submitted at the time of payment of labour bills. by this way they have broaden the net for esi coverage. even provident fund authorities have taken the same stand they are insisting the employer to deduct 25.61 as like deducting tds from the labour bill of the party and pay the amount in a separate challan every month. they have also been asking to furnish the particulars of the parties from whom tds is been recovered this they planning to make it mandatory as an annual return every year.
Canteen run by a private party - principal employer is responsible for payment of pf and esi for canteen employees?
Dear all good evening seek clarifications on the following : applicability of pf and esi for canteen contractor. 1. our company is having canteen run by a private party. 2. they are supplying breakfast dinner supper and tea/ coffee based on coupons. 3. company will pay the amount based on bills based on coupons. 4. no raw materials are provided to them. 5. only steam is provided to them for cooking purposes. for they are paying 0.50 ps per meal. 6. they have also obtained a license under the contractor labor act. we have included the canteen contractor name in our rc. our clarifications: principal employer is responsible for payment of pf and esi for canteen employees. regards ganapathy v

Hi i am working in an it company and we are deducting pf and esi of our employees from last nine months.now my employer wants not to deduct the pf and esi of employees any more.now my question is 1 is deduction of pf and esi necessary for an iso standardised company? 2 if not then is there any way of getting out of pf and esi? 3 is there any benefit to an employer of paying pf and esi to employees. 4 we are 25 employees in our company so if we will make it less than 20 can we come out of pf and esi as we are already paying it. waiting for kind and positive reply? thks & regards meenakshi
