Dear Friends,
Can we impose suspension as punishment to an employee without paying any subsistance allowance.
Actualy we have one employee who is found indulged in a misconduct. The employee was immediately suspended with pending enquiry.
The employee was found guilty of the misconduct. Now can we impose suspension without wages for one month as a diciplinary action/punishment . Please comment.

If the employee is placed under suspension after having found guilty you need not pay subsistence allowance because it is not really suspension but taking away of certain days of work or debarring that employee from work for certain number of days as part of punishment. However, before imposing such punishment holding of enquiry is mandatory.

Dear Vinay
1. You can impose suspension as punishment for maximum 4 days as per Standing Orders 1946 This should be after conducting domastic enquiry.
2. Maximum 4 days suspension as punishment is allowed. More than 4 days suspension without wages is illegal
