It is aptly said that "You cannot run a factory, complying all the requirements under the Factorties Act". It not only speaks of the multitude of requirements but also the impracticability of many of the stipulations. Hence there is a real need to have a relook on the Factories Act, it is high time. First of all, is there any need to renew the license every year so long as the manufacturing process remains the same, quantitatively and processwise. In the wake of Bhopal Gas tragedy many safety provisions have been brought into the statute book, but many of them remind us of the license, permit and inspection era. There is a need to have a seperate enactment for safety and other provisions. Safetyis a specialised area having wider connnotation with the engineering process involved whereas wefare is a totally different diamension. Even the penal provisions are too harsh but there is no responsibility for the factory inspectorate in rendering safe working conditions. Any prosecution shall be initiated only after wilful disregard of instructions given by the Inspector as regards unsafe conditions.
