Every month my employer disbursed employee salary after 10th.
Now till date my november'10 salary is hold my higher authority without any notice / intemation / any reson.
What legal action will taken against my employer.

Mr Somnath, firstly you need to ask your supervisor and your personnel peoples that why they salary has been hold by them. There must be some strong reason behind this bcz otherwise no one can stop your salary and without asking your immediate supervisor (your Boss) your personnel & HR department evan cant hold your salary.
You just need to find out the reason for the same and speak with your boss first and later go to the HR peoples and ask them to get you the specific or accurate reason for this.

Never jump into a conclusion and come to a decision to take legal action against your employer.
Be polite enough. Never hesitate to request your superiors and HR people.
Approach without any prejudice to your superior (through proper channel) (directly do not go infront of your Board Director or Managing Director with a complaint) If you do so then you will have to face the problem at all times and everybody will try to trap at every level.
Approach your section in charge and HR Department.
Ask them politely about the reason for not effecting the payment of November'10.
Confirm from them about any recovery or any deduction made in your payment due to which you have not received your payment. If so ask them to clarify the details.
Never Never think of going for legal action in the first step itself.

As previous conversation with my HR person her reply - 1. Your contract is over 14th dec'10, we are regrate to inform to you. But as per verbal instruction of my boss i also continue my service. But Till date they does not paid my salary nov, dec, jan.
But in this time 1st feb'11 i submit my resignation through mail & Registered post.
Presently you confirm me legal steps for recover my salaries & other pending benifits.
If i will go to court in which act will be implicate them.
For quick recover my due money which action i will take.
