Dear All,
Anybody can tell me how to face the Termination Letter?
I am working with a Pvt Ltd company in Kerala for the last 2 years and 4 months. The management decided to terminate me w.e.f 31st December 2010 onwards.
Expecting a letter from the HR Dept and please advice me the rules and regulations based on Govt of Kerala policies.
Should I give the resignation Letter, if the company ask me for that?
Should I complete the 30 days notice period?
How will be the compensation package?
Should the termination letter affect in my career?
Will the company issue the Experience Certificate?
Please clarify all these questions and advice me the stand which I should take.

In a decent way to come out of Termination is Resignation, in which you will not get any monetary benefits (notice pay, retrenchment compensation, etc) except your leave pay.
In Termination case notice period will not be given.
In your experience certificate they will mention your general behavious as unsatisfactory/unfair. But you will get the Notice Pay, Retrenchment compention and if you served for more than 5 years then Gratuity and leave pay.
If your previous employer mentioned your general behaviour as Satisfactory/Unsatisfactory/Unfair then your future employment will have a question mark.
Even you can not hide your previous working experience as the gap of unemployment will create some doubt in the minds of new recruiting agency.
At least please be fair and loyal to your new employer.

yes if the company ask u 2 resign then its better 4 u 2 resign coz termination is not gud 4 career.

If they will ask you to resign then i dont think that they will ask you to serve notice period and i will nt suggest you to do that. When company ask any employee to resign then they have to pay the notice pay and employee dont need to serve the notice period.

Regarding compensation package whatever notice pay is mentioned in your appointment letter should be given to you including the salary for the days you worked in the month of resignation.plus you will get all other benefits whatever is a part of your ctc in your salary structure.

Normally termination letter is not good and companies dont prefer to terminate employee until and unless something very wrong has been done by the employee. This you can talk with your hr deptmnt.

They should give you exp letter.

But all these things depend on the matter that why your company has decided to terminate you. If you are innocent then you will get the things whatever you ask.

But in any case try to give resignation not to get termination.

Now all the thing depend on the hr of your org. Just discuss with them and kindly let us know what they said on the matter.

I wholly agree with the excellent suggestions offered by our members.

They have also provided the logic and reason behind it, which are perfectly right.

In fact, this (termination) is the 'stick' that management uses to get 'resignation' from employees and saves itself of any further complication arising out of such erratic actions.

The only suggestion that I would like to add:

If your performance and conduct has been good; then you can discuss the matter of resignation with the management.

It is very much possible, under the circumstances, to get a notice period of one month, by giving a notice of resignation taking effect one month later.

Depending on the situation, management may also grant you your leave,during this period (which again will be debited from your leave account during final payments); which you can use for job-hunting.

It would be a very rare and ruthless management, not to grant you one month's notice, for the sake of continuity of your career.

Do give it a try.

I haven't give any notice from the HR as of now. But during the discussion with the management I cam to know that they are not interested to carry me further. And I personally was not at all interested to continue with this organization too. I have almost decided to leave from here by 31st Dec 2010 with a notice period of one month and planned to put the paper on 31st December 2010.

My question since they have already decided to leave me, i confused on whether i have to wait for the notice or I should resign. Normally this company as for the resignation letter from the employees and relieve them immediately.

As per the Job Contract with this company both the parties should give 3 months notice period before terminating the service. But I don't think so that this company will give me 3 months notice period. They usually take the resignation from the employees and relive them at the earliest. They don't even consider the notice period. This is what I am asking.

Since the mutually agreed notice period is 3 months, what should be the step I should take when they ask for me the resignation?

Should I give the resignation mentioning the 3 months notice period?

How can I get assurance from the employer that they will pay me the 3 months salary?

I was working with this organization for the last 2.5 years and sincerely doing the given job profile. All this happened because of the prejudiced mindset of few people among the management. I was standing against the backbiting and black politics which made them unhappy. Because of that only I decided to leave.

Now All of you kindly advice me what stand I should take?

Looking into the circumstances as cited in your post, I think what you have decided is the best option.
I have come across several cases in CiteHR itself, of several companies not honouring the notice period mutually agreed upon; and relieving the employee the next day of his submission of notice to resign.
It is very very sad to find that even HRs (in this forum) tend to support such a move by the management.
Despite my opinion that this is wrong on the part of the management and despite the employee's willingness to continue till the Notice Period, even if the management wants to terminate/releve him the next day, then management should give the notice pay.
Under the circumstances, what you can do; except to submit your notice of resignation on 31st Dec. giving the company thre months notice; (BUT ACTUALLY EXPECTING TO BE "HAPPILY" RELIEVED THE NERY NEXT DAY !!)
