Hi, I m working as Manager H.R in Interior firm. One of our employee who joined recently, has submitted an application requesting to stop deductions of ESIC Contribution since his father is Govt Servant, so he and his family is covered under CGHS facility. Can anyone tell me Is it ok to stop ESIC deduction?

No he cant if is salary is below 15,000 Rs ESIC contribution has to be deducted every month.

Dear Mr Chachad Kiran & All
Please note,
1. ESI deduction is statutory and companies are liabile to deduct the same from the eligible employees
2. No individual can come out of ESI deduction on his own
3. If his gross salary is upto Rs.15000/-, please deduct ESI contribution
4. Employee's parents, wife, children will also be covered and they are eligible for the ESI benefits

Talk to the concerned employee and explain to him that his request cannot be considered since his coverage under ESI is as per provisions of law. Vasant Nair

good Ques. What there in no provision regarding your ques.
in E.S.I.C. act & related amendment so it is complusery to deduct Contribution from both Side if Monthly gross in less than 15000.00

No we can’t exempt any single employee from ESIC whoever getting below 15,000. If you exempt that employee from ESI deduction then while ESI inspection you have answer it and you will be charged....

Hii Kiran,
ESI benefit is for the employees. We need to make them understand about this benefit, which they can avail from ESI. Unlike his father, a govermnet employee, wherein he wil be having benefits, similarly in pvt. orgn also, we have PF & ESI benfits , which is for employees. They consider this as a deduction from their salary, and are aware of benefits.So, my suggestion would be to make him understand about the benefits, since its a statutory law, not made by pvt. orgn.

No i don’t think so, because he is not dependent on his farther. After 21 years the facility what is farther is getting from government is not applicable to him.
