Earned leave policy - eligible for accumulated earned leave next year?
Our company credits 15days' of earned leave to an employee after the completion of one year from the date to joining. the calculation is that for every 20days' worked the employee earns one day earned leave. my question is that if he avails only paid leave in a year is he still eligible for 15days' of earned leave next year?
Earned leave / sick leave compensation against notice period.
I am working with an engineering mnc registered in mumbai ihave resigned and serving notice period of three months. i have 54 earned leaves 30 sick leaves and 7 casual leaves. i am told by my superiors that i cannot surrender my earned leaves against notice period for reduction in notice period and at the same time i cannot avail the earned leave also. in our company the earned leave cannot be compensated by cash and it can be carry forwarded for two years. please guide that is there any policy of government for earned leave compensation. can i take any legal recourse if i am not allowed to surrender my earned leaves or sick leaves against notice period and also not allowed to avail the earned leave during notice period.
Leave policy and resignation notice period
Please suggest me that in case an employee resigns and the resignation period being one month and the employee has also applied for his privilege/ earned leaves for a week or two during his notice period as well and still has left with leaves in his leave bank. kindly guide me whether we shall include or exclude leave period from his notice period and take the effect date of the notice period after his leaves are over as there is no mentioning in the leave policy that the leaves if granted during the resignation period shall be included/ excluded in the resignation period.

Hello everyone please let me know if there is any rule regarding the minimum no of leaves to be availed to be considered as earned leave. if the employee goes for 2 days leave and do not have any sick leave or casual leave in his/her account then in that case is he/she eligible to take earned leave or will that be considered as lop. thanks shweta
Is the leave encashment calculated on last earned basic or it is calculated on the basic for the period during which the leave was earned?
Hi please tell me how do we calculate leave encashment. for eg: monthly gross salary is rs.10000/ out of which basic5000 hra2500 medical1250 conv800 misc allw450 then how much would be leave encashment of 5 days?? is the leave encashment calculated on last earned basic or it is calculated on the basic for the period during which the leave was earned?

Dear friends though this earned leave encashment is being discussed at different times and forums still there is some difference of opinion. section 79 of the factories act 1948 says that every employee who works for 240 days in the previous year is entitled to earned leave 1 leave per 20 days of working. when the worker is discharged or dismissed or quits employment the unused earned leave at his credit has to be paid. a worker is entitled to accumulate upto 30 days of earned leave and over and above 30 days will lapse. suppose a person who is having earned leave at his credit more than allowable 30 days and has not taken leave nor organisation didnot allow him to take leave then the additional leave is to be compensated or encashed? is this the company policy or is it mandatory? this is not very clear in the factories act. i invite our learned friends to post their views along with mandatory laws/rules if any for the benefit of hr people. srinaren
