How we get 4.81% as rate for gratuity deduction ??????
Dear seniors can anybody tell me how we get 4.81 of basic salary as the rate of deduction of gratuity ???? i want the mathematical calculation ....
Non filling of gratuity forms & non deduction of gratuity as the in hand salary will be affected
My organisation is 3 years old and have more than 40 employees & we donot have gratuity policy in place. no forms of gratuity have been filled yet. neither the management would be willing to deduct the gratuity nor employees would be willing to get deduction for gratuity as the in hand salary will be affected & also already the attrition rate is very high. even if i get the forms filled now i cannot recover the gratuity amount for past & also wont be able to deduct for future. i would also like to add that we are not deducting pf & have got pf declaration form 11 signed from the employees as they don t want any deductions in their in hand salary. pls advise on the gratuity concern.
Gratuity and increment letter - in the appointment order, no terms are mentioned to provide gratuity
Good morning everyone i request you to clear the following doubts regarding gratuity 1. in the appointment order no terms are mentioned to provide gratuity for employees working more than 5 years. in that case are the company mandatory to provide gratuity? please clarify. 2. in the employee file which are documents to be maintained. 3. as we are providing increase in the salary slab i required a draft of increment letter for the teachers drivers and house keeping staff.

Dear ram v. the salary of an employee depends upon his salary rate i.e. piece rate daily rate or monthly base rate. mostly companies are adopting monthly wage rate system. it can be calculated as monthly wage rateno.of days worked/total no. of days in that month. e.g. if an employee joins of 16 of january at a gross salary of 10000then his salary will be 1000016/31 5161 rs. in the same way we can calculate the others salary

Gratuity is governed by payment of gratuity act. payment of gratuity act calls for payment of gratuity 15 days salary basic da per year of service to an employee who leaves employment after at least 5 years of service. in case the gratuity is due on account of death of the employee 5 years service is not required. gratuity is paid at the rate of salary at the time of employee leaving the establishment. any fraction of year exceeding six months shall be taken as one year for determining the period of service. as such one who has served for 8 years and 7 months will be eligible for 9 years gratuity. no amount should be deducted from the salary of the employee to find fund for payment of gratuity. it is sole responsibility of the employer. regards madhu.tk

Dear sir my confusion is gratuity is calculated on basic & da is gratuity is calculated on last earned basic & da??? or last rate of basic. please guide. eg. one of my employee is resigned her basic & da rate is 17670/& her last earned is 4560/ so on which rate the gratuity will calculate on 17670?? or on 4560?? need the guidance regards medha
