Hi,
After my resignation, my current employer blocked my salary for the previous month, and not accepted my resignation. they told me to work for 3 more months after notice period of 1 month , which is difficult for me and my future company not ready to wait for 3 months. they are not responding for mails also. Now I have servived one month notice period, on last day also I had wrote mail( i am working on client location), but no response from them.
They had blocked my salary for the month before notice period also.
I did not get any relieving letter and I have not done any relieving formalities , since there is no response from them even on last working day , I stopped going to the office after completion of notice period. I am ready to loose this experience which is of few months only, but how can I get my money back, and PF amount also. Will the employer take any legal action on me, since I stopped going to the office? Kindly let me know.

If you have fulfilled the provisions of appointment letter on Notice period, approach the labour commissioner in your jurisdiction for redressal. pon

Dear,

IF YOU HAVE COMPLIED & FULLFILLED THE TERMS & CONDITIONS OF APPOINTMENT , THAT IS YOU HAVE SERVED NOTICE PERIOD AS AGREED UPON AS PER APPOINTMENT LETTER YOU HAVE NOTHING TO WORRY OF.

Secondly your employer will not be able to hold back your dues as such they need to close the record in master , you will not remain active for long after being separated. Hence wait.

For your PF dues , you can fill in form 19 & (10 c -To be filled only if you have worked for a minimum period of 6 month with previous employer).

After filling up the forms visit your previous employers , obtain their signature with stamp on the form and submit it. If they deny to endorse the forms you may visit Regional PF Commissioner of the office where your previous employers were remitting dues of PF & Pension.

You will be required to make an application in writting , clearly stating that previous employers are not autorising the withdrawl of PF & Pension.( This should be done only after 60 days from the date of relieving , a representation by you be made to the previous employer and if needed to RPFC)
