Dear All, Can any body tell me how to prepare a Termination Letter from the Services or Notice for Termination from the Job for an employee. I need it very urgent? Thanks, Lalithaj

Hi,

You should be very clear as to why you are terminating the person. If it is for contravention of any rules or for disciplinary reasons, please be very clear that you cannot take recourse to this action without following the eloborate disciplinary procedure, based on principles of natural justice. This, in other words means, issuance of charge-sheet, domestic enquiry, and final disciplinary action as per rules of the organisation. Please check this befire you embark upon any action.

If the terminaktion letter is a simple termination of contract of employment, the language of the letter is kept simple and unambiguous:

" In terms of clause ..... of your letter of appointment, we give you ...months notice(Or three months pay in lieu of notice) for termination of your contract of employmnet. Your employment will terminate on ....... and you will cease to be in our employment with effect from .....fore noon. Your legal dues will be settled by the Accounts department during working hours on ....... You are advised to return all the company belongins to the Administrative officer by.... "

I am agreed with Cyril,
that we should be very clear to our selves that why we are terminating the person.
I have the draft for Disciplanary Action you just have to include the reason for termination and also inculde abt the disciplinary action u have take before you terminate somebody.
Bze I understand that u cant terminate anybosy without giving the notice If the employee is permenant.

hi pls tel me if any co taking 24% of employees basic salary as PF ( 12% Employee Side and 12% empoyer side )so would it be leagally currect if not what could be the negative impact.

Dear ALL
Kindly Help Out....
I want to terminate an employee based on building grounds and can at least nail him on code of conduct ( Chewing pan parag, derogatory comments about of senior management and caste remarks) absenteeism ( does not return to office and no movemnet update despite several warning). Also has been instrumental in inciting staff to rebel against company policies etc.

Shall i take it forward......

I think you should first of all give him a memo or written notice if his behaviour after that also doesn't change then you can terminate him. For the disciplinary memo you can refer to the memo attached by Rinky above..

Your employment with Blank Company Inc. is now over. The recent events and problems related to your work performance occurred when bookkeeping noticed miscalculations on your paperwork and money missing from the companies account. This has happened in the past, and no matter the repeat warnings, you cannot explain why the miscalculations happened, or why the money is missing. Therefore, we believe that you are not performing your job duties to our standard.
Blank Company Inc. would like to offer the following offer, which will help you in finding new employment elsewhere and reflects the years of service in which you have provided to us:
1) Blank Company Inc. will continue to pay you 100% of your salary for the next three months. If you secure employment elsewhere within that three month period, Blank Company Inc. will pay you a lump sum equal to 35% of the wages in which you would have accrued for the balance of the period.
2) All vacation hours and sick days will be paid in full within the next three months.
