Shops And Establishment Act. - Wages Act

Hi, i’m in need of Shops and establishment act, 1953. also please let me know if they differ in each state. Thanks Kavita

Hi

The shops and establishment act for each and every state are different as this law is under the powers of the state and not centre.

According to my knowledge if your company is based in Pune, the Act for Maharashtra would be applicable for you.

You can find a copy of bare act of shop and establishment act on any shop that sells articles/books related to labour laws or laws.

The prescribed fee for registration and renewal etc. may differ from other part of the state as per notification of state govt.


Generally the following Registers/ records/ notices etc. are to be kept by the different categories Register of Employment

*A Muster-Roll – Cum-Wage Register as laid down under Rule 27(1) of Maharashtra Minimum Wages Rules 1963
*Visit Book ( Rule 20 (13)
*Name board in Marathi (Rule 20-A)
*Display of abstract (Rule 20(7)
*Display of Reg. Certificate Sec 7(2)
•Notify to the Sr. Inspector (Shops & Establishments) at the beginning of the every calendar year regarding list of closed day of the respective year
etc.
In addition to this Act, the authority under the act also empowered to enforce the provisions of the following acts and rules framed there under
• The Minimum Wages Act, 1948.
• The Payment of Wages Act. 1936.
• The Workmen’s Compensation Act, 1923.
• The Industrial Employment (Standing Orders) Act, 1946.
• The Maternity Benefit Act, 1961.
• The Child Labour (Prohibition and Regulation) Act, 1986.

So alongwith this Act ,you will have to maintain other registers as prescribed under the various act as and if applicable.

Shilpa reply is very useful. As per Shop and Establishment Act you have to some more registers, notice also.

i.e.:
Deduction from Salary Register,
Fines,
Advances,
Service Register

Weekly Holiday Notice,
"There is no child Labour" - Notice,

I like to know the rules and regulation to put Name board in Marathi in Pune city.
Do I have to write office timing and weekly off also in the name board.
