An associate was deputed abroad through the company. During a long wekend, he went with his friends to the beach . He met with an accident , then died in hospital after battling for life for 4 days.His total bills came to $140000. As per the shops and establishment, the accident could not be related to the office, how far should dues be released??
I DNT HAVE ANY OTHER DETAILS ABOUT THIS CASE. I HAVE TO SOLVE IT BEFORE 17TH. PLS HELP ME BY GIVING YOUR VIEWS.
THIS IS A CASE STUDY THAT WAS GIVEN TO ME. I UNDERSTAND ITS VERY VAGUE. STILL.. I WILL HAVE TO SOLVE THIS WITH THE GIVEN SET OF INFORMATION

IF IT IS AN INDUSTRIAL ACCIDENT THAT LED TO DEATH OR IF IT IS IN THE CAUSE OF THE JOB THAT THE ACCIDENT HAPPENED, THEN WE COULD SAY THAT THE ORGANIZATION WILL HAVE TO OPERATE/OR PAY USING THE WORKMEN'S COMPENSATION ACT.
BUT NOW THAT IT CANNOT BE TRACED TO WORK, I WILL SUGGEST THAT AS A WORKER WITH THE ORGANIZATION. IF HE LEAVES VIA RETIREMENT OR RESIGNATION, SOME AMOUNT WILL BE ACCRUED TO HIM, IN TERMS OF GRATITY OR PENSIONS. I WILL SUGGEST THAT SUCH AN AMOUNT BE GIVEN TO THE NEXT OF KIN SO THAT THE BILLS CAN BE TAKEN CARE OF.
IN WHATEVER CASE, THE ORGANIZATION STILL HAS A ROLE TO PLAY

Basically u need to read and understand the terms and conditions mentioned under deputation.
If total period of his deputation is treated as on duty as per ur terms, then u r bound to pay the dues else ur liability will be limited to paying of gratutity under payment of gratutity act.

Hi,
All the international travels, assignments of employees are usually covered under the International Insurance. Please check the scope of the insurance. I am sure the travel agent has taken the precaution. If yes then the organisation will have to help process the claim and provide the support to the next of kin of the employee.

Hi,
If it is international Travel the traveller is bound to take
insurance, otherwise, the destination countries will not
allow any foreigner to enter. In your case definitely the
deceased may be covered by the insurance. Speak to
your travel agent and settle the case as per insurance
terms.
