You are all requested to provide me the exact definition of employment injury in respect of accident report under ESIC act.
If an employee meet with an accident after the duty hours and outside the area of office / factory premises. will it consider for any benefit from ESIC???
Note: Now after introducing esic.in, how can we submit the accident report. As site is having the Form 12 from employer side, earlier i think form 16 has to be submitted in any accident case at local office within 24 hours.

Dear Vikas,
Employment injury means a personal injury to an employee caused by accident or an occupational diseases arising out of and in the course of employment.
There are some cases where accident arises outside the premises and even before and after working hours is to be considered for insurable amount.
For Employers side :-
Form 11 -Accident book
Form 12 -Accident Report from employer and
dear Form 16 is Claim for periodical payment of Dependent Benefits by IP/Beneficiary.

Following a latest amendment to ESI Act injury caused to an employee while he is coming to the place of work from his residence and going to his residence from the place of work are also treated as employment injury for availing benefits from ESIC provided the time and place of accident meet with his usual time and route of commuting.
