I am working as hr assistant in pvt. ltd. co. (near 200 employees working in company) I want to know how many and which type of registers and forms are required to maintain as per factory act rule and company law. please describe with full name and No. of register and form.

Dear professional.
Whenever you find that you have to maintain something statutorily, please procure various acts (specially applicable to your state) like, Factories Act,1948 with rules (pertaining to your state), Minimum Wages Act 1948with rules (pertaining to your state), payment of wages act 1936with rules (pertaining to your state), Bonus Act1965, PF & Misc.Prov.Act,1952, ESI Act,1948with rules (pertaining to your state).In each of these acts on the last pages various forms are quoted along with formats. You have to maintain those formats. Some of the format are available locally in the form of register.
Thus, instead of only becoming a master of maintianing various forms/register, you can add knowledge about the act, which will pay you at evey stage when legal questions arises.

Pl. buy Factory Act Book and first study the entire book and treat as Bible and follow the same , it contains all the forms pl. follow the forms.
Apart from this , Pl. visit the factory Inspector office , meet ur Concerned Inspector and develop relationship and get required information and guidance from him.
All this will help you to implement the best practices and u will be expert in this field.

First examine which of the Factory Rules i.e. Central or State & if State then which of the State are applicable to your establishment & then go through the applicable Factory Rules to have knowledge on different types of format for maintaining different registers under this Act & Rules.

Dear PCPL,
Register to be maintain as per Factory act, 1948 are as follow,
1. Register of Accident and Dangerous Occurrences-In Form 30, Should furnish before 15th Feb a copy of the entries in form 30.
2. Maintenance of Inspection book - In Form 31 of Size 35cms*20cms shall contain at least 180 pages.
3. Register of Child workers (sec 73) in Form 19
4. Record of white washing Sub sec (1) of Sec 11 and Sec 12 (Register maintained in Form 8)
5. Register of Adult workers shall be maintained in Form 17 and shall be written up a fresh each year and shall be preserved for a period of 12 months.
6. Leave with wages register in form 20 rule (105)
7. Muster roll shall be maintain in Form 29 showing
a) Name of each workers
b) Nature of his work and
c) The daily attendance of the worker.
Muster roll shall be written up a fresh each month and shall be preserved for a period of 3 years from the date of last entry in it.

15. Maternity Benefit Act, 1961

Cash Benifits: Payment of medical bonus is Rs. 1000 insted of Rs.250 ( u/s 8 )

02.Records to be maintained:

A) Every employer shall prepare and maintain a Maternity Benifit Register in Form – 10 ( See rule 12(1))

B) ANNUAL RETURN:- on or Before 15th Jan employer has to submit the return in FORM -11 (See rule 15)

You need to pay a medical bonus of Rs.1000/- and maternity leaves for 12 weeks with full salary.

This point shows that only Form 'L' is to be sent in the shape of annual return to the Complete (competent) Authority upto 31st jan

Married Female employee is entitled for maternity leave as per Maternity Benefit Act 1961 or The Employee State Insurance Act 1948 as per the provisions of the Act whichever is applicable to her.

1. Make sure the salary is more than 10000 pm. if less than this you can avail the maternity benefit only under employee state insurance act 1948

2. To be eligible for the Maternity benefit, the employee should work for a period of not less than 80 days in the twelve months immediately preceding the date of her expected delivery.

3. The employee should give a notice before 8 weeks in advance for maternity leave supported by a medical certificate

4. Maternity leave is an additional leave other then the usual leaves/ facilities existing

5. The Employee will be paid full pay up to 12 weeks approximately 6 weeks before delivery and 6 weeks after, provided that she undertakes not to take up with any job during these 12 weeks.

6. If this leave is extended, then the payment will be done to the extend of credit balance leaves in her account else it would be leave without pay.

7. No pay shall be due or payable in lieu of unavailed maternity leave

I hope the above will surely help you to take decision and make up a Maternity policy for future instance.

i) Under this Act Muster Roll in Form ‘A’ as per Rule 3 Maternity Benefit Rules has to be maintained, for which the following particulars are needed in respect of the women employees who avail the benefits under the Act.

1) Name of the women employee

2) Age

3) Date of giving Notice of pregnancy in Form ‘D’

4) Amount of wages paid

5) Period of leave: From To

The above particulars have to be furnished as and when the beneficiaries apply to avail the benefits.

J) The employer is bound to supply copies of Forms ‘B’, ‘C’, ‘D’, ‘E’, ‘F’,’G’, ‘H’ and ‘I’, free of cost to every women employee who requests for them as per Rule 12.

k) All the records so obtained have to be preserved for a period of two years from the date of preparation.

L) Abstract of the provisions of the Act and Rules in Form ‘J’ has to be displayed in a conspicuous place in the establishment.

m) Annual Return in Form ‘K’ has to be submitted on or before 31st January of every year.

16. Employment Exchange (CNV) Act.1959

* Notification of Vacancies - Form – 6

* Quarterly Return - Form: ER-I (Mar, June, Sep, Dec) before 1 month

* Bi- Annual Return - Form: ER-II (Once in 2 years)
