Hi
I was working with MNC bank on a contractual position on a third party payroll. I have got another permanent job in a good company so I have resinged and served full notice period of a month and all my no dues formalities have been done on my last day. Its about a month now that I left XX bank but did not receive my last salary from that agency. I am continously calling them everyday - either they dont receive my calls or if by mistake they take, then the say that we'll get back to you. They dont reply to my mail even, I have written so many mails to them.
I have all the documents accepted copy of my resignation, relieving letter, copy of no dues form. I wrote to my x manager at Bank but he clearly said that you need to chase that agency.
Can you please suggest any leagal way to get my salary.

Hi Dimple,
Before pursuing legal options, you would be better off approaching the HR or concerned official of the third party agency for clearing of your outstanding dues. Many companies follow a policy of delayed payments / waiting 45 days before clearing last salary.
If that does not work, then all you need to do is approach a labour issues lawyer and get him to send a notice to the third party agency for payment of your outstanding dues. This should sort things out as most companies pay up immediately upon receiving a lawyer's notice.

in this now you should not do furthur verbal communications just writ a polite mail to concerned HR of that agency. & then put a reminder atleast after a week & keep a record of all written communications, but don't give them any hint that you will go legal. If in two or three reminders they didn't reply you anything put a strong mail indirectly indicating that you will take a strong step. all this will help you in case you want to do legal proceedings otherwise your case will not be very strong.

Dimple,
You write a letter to the H.R Dept of third party agency (On whose payroll you were working) and send one copy to the HR Dept. of the company (Private Bank) where you was working.
If than also the issue is not addressed than foward this letter to the Head of the third party and M.D. of that bank and mark the copy this time to both the HR depts.
It will work surely.
If not than forward the same letter to the ACL at district level, State level and at central level and see the impact.
All process through email or by Reg. A.D. Only, to have the proof of acknowledge.
