Dear Friend,
On receiving the explanation to a show cause notice and finding it not satisactory the next step is to frame a charge sheet and proceed with conducting an enquiry.
You have to fix an enquiry officer, date and time for the enquiry and advise the charge sheeted employee to attend the enquiry. He is also to be advised that he can seek the help of a co-worker to help him with the enquiry proceedings.
The enquiry officer shall conduct the enquiry giving all that opportunity to the charge sheeted employee to prove his side, cross examine witnesses and examine the documents produced. E.O. has only to find whether the employee is guilty or otherwise. If found guilty appropriate action can be taken by the management.

In case the subject matter of the SCN requires imposition of major punishment like then a domestic enquiry can be fixed. Otherwise and if there is no past history of the employee it is suggested that the employee can be called and orally convinced to give revised explanation letter accepting the misconduct, based on which suitable minor punishment can be given. Otherwise, the principles of natural justice to be followed in conduct of domestic enquiry.
Even in domestic enquiry, at the commencement of enquiry, the EO shall question him on acceptance of charges. If he accepts the charges in toto, then the same shall be recorded and closed. If not, it becomes the responsibility of the complainant or Management Representative to prove charges and delinquent worker to disprove the same.
