In this case one holding company has three subsidiary companies.
One of subsidiary companies having the PF number. other subsidairy does not have started its operation and are at infant stage.
Can holding company has to enroll for the PF under section 2A of the PF act.

If the holding company and subsidiaries do not have separate registrations under the Factories/ Shops and Commercial establishments/ Plantations/ Mine Act, as the case may be, for PF applicability all the units will be treated as one and accordingly the employees will be covered.

Dear Madhu.T.K
Thanks for the reply.
In this case Holding and subsidiary are seperate entity registered under companies act and having seperate license under shops and establishment still holding company having 14 employee have to registered with PF.
If your clarification with couple of caselaw references will have an add advantage.

If the holding company has not ever crossed manpower of 20 in the past there is no chance of it been covered by PF. If you have separate registrations for each units and you have separate Financial Statements for these units, you may present the same before the EPF Organisation.
