Company is holding original education certificates (10th class & Plus two) of all employees for a period of three years. Could anybody help me, is there any rights to hold original education certificate by company? How can employee approach court?
Dear Manoj, No way anyone has the authority to retain the orginal education certificate of the employee. But since it is a security company, they may have taken in custody as a control of the employee. Rather going to court ask the employer to return back your certificate. There cant be any bonding that you have to work with him for such period. If he deny to return back then you can go to police or court.
Im agree with Jiten that they have no authority to keep this originals but differ with this custody procedure. Because there are number of work wherein an employee need these originals and without certificate he/she wont be able to do the same.. Please go to your immediate supervisor/boss and tell him/her your story and try to get your certificates. You can tell them that you need these certificates for further study and have to submit the same to the Education Institution/collage for your admission purpose. Further you can take legal action as Jiten has suggested above if they denied to return it.
Hi friends, Pls guide me..I too have the same kind of issue..I have submitted my 10th,12th and UG degree certificate to my previous employer..I've also signed a bond for 2 years..But due to verbal harassment by another Team Leader,I abscond from that company..To get back my certificates I have to pay some amount as per the agreement which I have signed..But Im not in a position to pay such a lump sum..Is there any other way that I can get back my certificates...And also by this september the bond breaks up....But I ve served only 6 months there??
