I want to know what is deemed dismissal. For example A an employee of an govt organisation charge sheeted for long absenting and accordingly he was removed from the service on the recommendation/findings of duly constituted enquiry committee. On receipt of the removal letter he applied before the employer that he was in custody for some criminal cases and it was not possible for him to inform the management and he was not intentioally absenting from his duties. On receipt of his explanation the matter was referred to higher authority. On enquiry it was revealed that the employee A was convicted by the lower court under Cr.PC and he was taken into the custody. Thereafter he challenged the order of lower court to higher court and subsequently he got bail and case is under subjudice. But on the judgement of lower court management taken action under clause moral torpitude against the employee A and dismissed him from the service. Now higher court asked the management to issue deemed dismissal. Is it possible as employee A already removed from the service. Kindly advise about the demeed dismissal and what type of letter to be issued again to the emplpoyee A.
