Applicability of labour licence to staff
Dear all i need your guidance for my query that labour licence is applicable to staff or not. staff means engineers supervisor managers gets hr & admin staff etc. whose salary is more than 10000/ pm. for example: my company itself a contractor and we have employed 380 workers & 100 staff. we have taken labour licence to cover 400 workmen. here we consider only our 380 workers for labour licence purpose & excluded staff from labour licence. is it legal or we need to cover staff also. kindly advise regards ram ahir

Hi i am in a complex situation where i worked for a company for 7 years in india and then they sent me to onsite for 5 years with condition that gratuity will continue in india they transferred my payrole to its uk branch they kept issuing me increment letters about increment of basic rate in india with condition if i join india back it will be the increase basic i worked for 5 years in uk and resigned in uk and did not go back to india now company wants to give me gratuity for 12 years 7 india and 5 for onsite deptuation with calcuation based on my 5 years back basic salary and not the incremented basic as they say that you never joined back. but to my understanding they would have considered as payable basic. even if the last paid basic then it would have been uk last paid though there is no basic component in uk payrole but only gross regards sannu
Staff has no right for over time. does factory act have different rules for labour or staff?
Hello i am working in a manufacturing co. as an hr executive there when labour does work above the 8 hrs they are consider for the over time but when staff member does the work above the 8 hrs. they don t consider for the over time. so plz suggest me that is it correct statement of my boss that staff has no right for over time. does factory act have different rules for labour or staff?
Query related to notice period
Sir i am working in a pvt ltd co. i was selected on off payrole in feb 2010.after 6 month i was on payrole of a company but i was not gvn any offer letter but my salary is credited to my act directly from company acct. now i got a chance in new company and they are offering me a huge salary my notice period was 15 days when i joined my co.i have to join new co on 12 dec 12.i submited my resignation letter on 26 nov 12.but my co is saying me to serve a 01 month notice as i am onrole now i have to serve one kbt notice periodbut i don\'t have any offer letter it was my mistake i did not ask it as my co never deducted any money of mine from any month salary and i am the only employee in kolkata operating frm my house and reports everyday by mail to head office.my new co is saying to join me as earlier ad possible i was unaware that my notice period is of one month.sir what shall i do now.inform me.

In my hosp there r 10 temporary staff ie hired staff from agency already we have 15 permanant staff ...as and when nnecessary we hire the temp staff ...what to do wen the union is asking us to make the temporary staff permanent it is an extra financial burden for us
Contract labour as principle employer - if the limit is exceeded some time for some additional work?
Hi i am working in pharma company as managerhr &admin. we have company staff of around 200 staff. apart from that we are having contract labour. in contract as a principle employer we have got permission from if for 180 staff. if the limit is exceeded some time for some additional work. in that case is it necessary to increase the staff limit being provided by contractor from if. if so is there any violation for such additional staff. as per factory act company should have canteen facility where the staff strength is more than 250. since our company staff strength is around 200 we are not having canteen so far. the contract labour will be taken into account for the above parameter then the staff strength is more than 250. please advise 1. can we ask the contractor to increase the labour strength i.e more than 180? 2. we have to open canteen at any cost? thanks. karun
