Dear Friends,
I need a details regarding payment of gratuity to employees.
I know that as per gratuity act, minimum 5 yrs of service is applicable for claiming gratuity amount.
But in a situation like lay-off, retrenchment whether an employee is eligible for gratuity if service less than 5 yrs, even there is not fault with the employee.
Please provide me with the details.

just kind your information every employee should have 5 year continue in the organization otherwie he is not eligible for gratuity.
then after ur second question some org use his owan rules and criteria of graduity

is it related with pf account no 0.50
which place gratuity is decided and what is procedure for them

Yes in case of death before 5 years the empe is liable to get gratuity for the tenure he has worked in the organisation.

Section 2A states :-

an employee shall be said to be in continuous service for a period if he has, for that period, been in uninterrupted service, including service which may be interrupted on account of sickness, accident, leave, absence from duty without leave (not being absence in respect of which an order treating the absence as break in service has been passed in accordance with the standing order, rules or regulations governing the employees of the establishment), lay off, strike or a lock-out or cessation of work not due to any fault of the employee, whether such uninterrupted or interrupted service was rendered before or after the commencement of this Act.

That means Continuous service includes the days he had been laid off under Standing Order or ID act..

Payment of gratuity :-

(1) Gratuity shall be payable to an employee on the termination of his employment after he has rendered continuous service for not less than five years, -

(a) on his superannuation, or

(b) on his retirement or resignation, or

(c) on his death or disablement due to accident or disease

I'll working current org 4 years 11 months. i give the res. letter for last month of my gratuity period. i'm eligable for my gratuity?
