Dear, we have an off-role worker and want to terminate him on the ground of misconduct, so pls. suggest proper course of action.

Since the employee is not your rolls there exists no legal relationship between you and that employee. If you do not want his service you can instruct the intermediary under whose roll he is not to send him to your establishment, that's all.

Dear Member,
If you want him to terminate on ground of misconduct then first you kept him on roll & then if the misconduct is major miscoduct then after conducting the domestic enquiry if the charges are found proved then consider the case of termination. You are asking us for giving suggestion for proper course of action while on the other hand your action by not keeping the worker on rolls does not seems to be proper in the eyes of law. When the worker is off roll then termination is also off the record.

When you say that the employee is off roll you dont need to bother of his termination, just pass on this message to the intermediatory to takeup the process with comments of your dissatisfaction; only think you should be looking at is, he does not report back to work.
