Apart from the IT point of view, one moot point needs clarification. When the act itself as amended takes effect from 24th May, the date of issuance of the Notification, how can the Central Govt employees who superannuated after 1.1.2006 and those in PSUs after 1.1.2007 get benefit of the increased ceiling, retrospectively? Is it that such employees, whose gratuity payment has not been released so far, are entitled to draw the amount calculated as per the revised ceiling of Rs.10 lakhs and those who have been paid only Rs.3.50 Lakhs are now entitled to draw the difference calculated keeping the maximum of Rs.10 lakhs? The Central Govt had announced the revised ceiling of Rs.10 lakhs wef 1.1.2006 as part of the wage revision and, therefore, it must pay the increased gratuity to its employees who have superannuated after 1.1.2006.

Dear Member,

Employees who got retirement on or after these cut off dates are entitled to receive the difference of gratuity amount if payable.
