Hi ... i resign from the company and my resiganation is accepted by my manager with duly sign for notice perod of one month from the date of resignation however the company s termination policy states that " your service may be terminated by giving three months notice period in writing or payment in lieu thereof by company. please however note that should you effect such termination by resignation you shall be required to serve the company for a period of not less than 90 days from the date of your resignation." i want the company to relieve me within one month as discribed in my resignation letter i am also ready to buy out the two months of notice period. however hr is not ready to do so. is it legal ? what should i do ? please solve my query ....
Increasing the period of notice
Hi to all i am working with an mnc in mumbai since last 04 months. in appointment letter issued to me the clause with respect to resignation/termination of an employee was 30 days notice period required to be given by either side. now the company has come up with a proposal that they want to reissue the appointment letter with similar terms of services except that of resignation/termination clause. the company has proposed to 60 days notice period in case of termination/resignation of an employee. my question is that whether the companyy can legally do so? if yes whether the employees are having any remedy on this? thanks armaan

Termination option for employer during employee's notice period service pending resignation
An employee who is already serving a notice period of 30 days after acceptance of his/her resignation is found to have involved in a case of corruption or illegal gratification during a period prior to the date of resignation offer. now can i initiate a termination procedure by issuing a shortperiod show cause 7 days or so and ordering an inquiry ? what are the legal implications ? can i extend his resignation date until inquiry completed ? will the person be under suspension beyond the originally proposed resignation date ? does the employer have to pay him/her regular salary during the excess retention period ?
