Dear All,
My Managing Director recently called me and told that all people in the company, including him and other director to be taken on payroll of the company and he should be also given PF professional tax and other benefits exactly in same manner given to a regular employee.
We are a Pvt. Ltd. Company.
Now my question is can a Director or Directors be treated as an employee of the company?
Can we allow them to have Provident Fund and other benefit? Kindly provide reference of the Act or judgement

Any Director in the company receiving remuneration and perquisites would be termed as whole time Director. The Managing Director is also a whole time Director. The terms of appointment of whole time Director may contain the benefits and facilities on par with other employees.

Yes the PF can be diducted from the salary of a Director but in the accounts book you need to enter the salary of director as Directors Remuneration not as salary. Vijay

I agree with Hyderabad, India, Suryanarayana S V's reply above but with following qualifier:
The director of a pvt. ltd. company owning a factory who has been appointed as its `Occupier' under the Factories Act, 1948, cannot claim to be an `employee'. He is treated as the `employer', the person having ultimate control over the affairs of the factory.

Dear All,
Suppose a retail company has 33 % of its revenue towards employee (manpower) cost i.e. salary paid towards employees salary and these expenses are inevitable.
How HR can help to reduce in this manpower cost without decreasing employee's strength?
The company is a small enterprise into retail and its all revenue comes from retail sales through its stores spread across India

Dear Govind,
You should more concentrate on Increasing the efficiency of the employees, rather than much concentrating on reducing cost. in the preview of your question, its impossible for any one in this forum to suggest the ideas for cost reduction. its you, who have to make the analysis of the cost incurred - since the data / statistics / process is not available.
You can compare the last two three quarters - cost incurred for manpower. then the analysis has to be done interlinking the same to Efficiency & Performance. there are so many factors in the HR. Without analysing the scenario, if you directly jump on cost reduction, the same might effect the motivational level of your employees.

Friends,
The University Grants Commission (UGC) is an apex body in India to monitor and approve universities. However, it is one of the worst and useless body under Ministry of HRD, Government of India. In the past, many times I complained them about certain fake institutes offering degrees and for the shock, even they are offering medical degrees like MD, MBBS, Ph. D etc. For my shocking I have found some of the top management (At Director level) using this degrees to prefix Dr. with their name.
as an Human Resources Professional, I am putting list of such fake institute. Beware! never hire any of the candidate from these institutes and for those who are planning to pursue higher studies, please don't opt these institutes for your degrees as a learned HR professional and a professional HR department will never accept these qualifications. I appreciate Pune University. This University is self monitoring such institutes at some extent and keeping its database updated.
