Hi all ,
I have put my resignation on 7th May 2010. Till that time company policy says that notice period is 1 month. My manger calls me for discussing the resignation and inform me that there is new policy abt to publish w.e.f. from 1st may 2010, and new policy have the notice period of two months.
Am i supposed to be in same organisatio till 3 months ?(Offer lette talks abt 1 months notice period )
Are there legal procedure to get the Releaving letter.

Untill the new policy is released, you are bound by old policy.
The new policy cannot be retrospective.
You are covered under one month notice period policy & should be released accordingly.

Hello why thinking last job if u left don’t go there as ur leaves will aslo balance so na matter for notice period.

Dear Amit,
I believe you might have accepted a copy of offer letter / appointment letter wherein the terms of employment are explicitly mentioned. The said document is an agreement between you and your current employer and those terms cannot be changed unilaterally, even if they are, an agreement to that effect must be signed by you with prior notice by your employer. Therefore, you need not be worried about completing your notice period which says 1 month.

as far as my knowledge concern there is no any restriction to complete your new two months notice period you are bound to complete your one month notice period after your resign, furthermore if there is any amendment in company's policy after signing of your agreement they must inform you in written and get signed on each amendment, sometimes new roles and regulations are not applying on previous employees.

Issue here is quite strong and in favour of timasingh, but in case the organization does not acknowledge for one month notice period, is there an external platform (Government/Non-Government) for greviance redressal?
I too am facing simillar kind of a situation with some differences. In my case the 3 month notice period is well understood between both the parties (employee and employer), but there are chances that the organization tries to hold me ahead of 3 months.
In these casees, are organizations free to do whatever they want, or there is some legal way out for getting the relieaving?
Help is really appreciated.

Dear Tima,

Any notification of revised policy or amendment issued after submission of your resignation letter can't be binding on you, as you are supposed to be regulated by the existing rules as on the date of submission of your resignation, as per the terms already communicated to you, either through the agreement you entered in to with the company, or through any notification issued thereafter, but before submission of your resignation. Any policy cannot be predated before the occurrence of any event (resignation in your case) to the disadvantage of the employees. The revised policy, if any can be applied to the future events occurring on or after the issue of amendment.

You can ask your manager to communicate to you in writing what he had verbally said to you. I am sure, he won't do that. You need not modify the period of your resignation notice.

One more thing. Be cautious, if you are asked to receive the amended policy on any later date, don't put your undated signature in acknowledging the receipt. Must put the actual and clear date of receipt on the copy of the office letter, even if you are insisted not to put any date.

I had face same kind of situation in last year
But after asking about written documented policy they denied and than previous employer release me according to company' old policy.

Hiiii, new policy will be effective from 1 May,and you hav already submit your resignation on 7th April.So you are bound to old policy olny.
