Controversy on renewal of labour licence
Dear seniors a company obtained a contract from central psu for work to be completed and handed over to the state electricity board thru psu. the labour licence is obtained on the formv of state elec board. now the situation : 1. the state elec board is not registered with the labour dept. 2. psu is registered with central labour comm. hence the alc state rejected to renew please advise on the following : 1. how can this licence be renewed. 2. which is the mointoring/ governing authority 3. is there a need to take a fresh licence from the central labour commr. 3a. if yes what would be the impact on the contract assigned. commercial implications by the psu for not abiding the contract provisions please suggest.. regards srinivas
29 labourers deployed in two different contracts - is it mandatory to obtain a labour licence as per the contract labour act?
I require clarification on the following: a contractor has two different contracts in the central psu with central wages. in one contract he deployed 19 labourers 15 labourers 4 retired railway employees and in another contract he deployed 10 labourers. is it mandatory to obtain a labour licence as per the contract labour act?

Dear all kindly advised whether a labour licence which has not been renewed for more than three years can it be renewed taking into account the fact that the orginal labour licence has been lost.can the labour office issue a duplicate & amended labour licence in such case? if yes what will be the detailed procedure for the same. if no what are the other options available.can a re registration is possible in this scenario. awaiting your earnest response thanks & regards ohla

India has more than 50 central labour laws. there are central machinery and state labour department to enforce labour laws. of course state govt.'s own labour law is enforced by state labour dept. those 50 central laws are classified as below yes. many state govt. has their own labour law rules for these 50 labour laws enacted and enforced by central government esi pf etc labour laws enacted by central and enforced by both the central as well as the state governments labour laws enacted by central government and enforced by the state governments each labour law says appropriate govt. is the implementing authority & registration/compliance procedure. many act does not provide for registration or licence which are directive in nature. many acts says appropriate govt is state govt. for private establishments. now question for registration & compliance: a private establishment has ho and branches in same state as well as other states. assume company has books of accounts centrally & employee payments are done ho level/ or payment done locally branch level. 1 does labour law dept. provide common registration number for all labour laws? i know ontract labour has separate regn/licence numbers but what about bonus act gratuity act minimum wages act etc 2does branch should separately submit labour law returns to the jurisdictional office? 3how the return submission should have reference of establishment/branch? 4gratuity act says if company has branches more than one state central clc is the jurisdiciton. how the switchover works? practicing labour law consultants may educate the group.

I am working with r. r is having huge civil contracts. for these works labour is being supplied by v from a village called p. nowadays state administration is objecting movement of labour from village p. state administrationis saying that for movement of labour a valid labour licence should be there with the person who is arranging movement. my question is who is to obtain labour lience. r is telling that i need labour but being supplied by v v is to obtain licence. v says that i am supply labour for the work of r so r has to take licence. can i can get an advice please.
