I am a service provider of big generator sets and giving services to several companies, few days back one of the company's HR manager asked us to give separate challan of the employees working in their company on our behalf. Since I have only one ESIC number can any estblishment demand for separate challan of the employees working in their company.
Here, as per the ESI Act, the employer has to cover the ESI to all employees working in the organisation.
Since the Principle employer have an obligation to apply the legilation to all employees including contract labour, he has to show the proof of contributions paid as per the act while inspection.
Moreover, if the contractor fails to cover their employees, the principle employer is fianlly responsible.
In this regard, you can give proof of challan paid and contribution details of your employees under contract labour.
You need not take seperate code or seperate challan for this.
