Dear Sir,
We are one of the manufacturing co. in Goa governed under Factories act. One of workmen working as electrician has taken 15 days leave on telephonic request but not submitted written request and he has extended the same for another 20 days. He has got 75 days balance to his credit.
Can we accept leave without leae application.? What are steps we have to take.? Can we make leave as unpaid? Can he be terminated for remaining on leave without submitting th leave application. Only his HOD has talked to him over telephone and has told him to submuit medical certidficate. But so far on lapse of 18 days he has not submitted the leave application.
Please advice.

Any leave has to be applied for and the same has to be sanctioned by the competent authority.You cannot take leave as a matter of right. Explanation can be sought and disciplinary action can be initiated for not regularising the absence.
