Dear fellow colleagues,
I would like to know are there any legal issues involved incase of the following benefits:
1. PF
2. ESI
3. Gratuity
4. Pension
5. Leave Structure:-Is it legally defined.
6. Leave enchashment
Is it legally mandatory for every company having more than 20 employees to give the aforementioned benefits to the employees? Or is it the companies own wish?

i would like to know whether your company is a manufacturing unit? or registered under factories act. as for as pf,esi gratuity concern if you go through the respective act it is clearly given. if any other issues let us know.

All the things you have mentioned i.e
1. PF
2. ESI
3. Gratuity
4. Pension
5. Leave Structure:-Is it legally defined.
6. Leave enchashment
are covered under concerned labour laws.Whether you are registered under Factories Act or Shop & Establishment Act once you touch or cross the limit of employees as mentioned same time you comes under the Act and it becomes mandatory to compliance with the provisions applied to you.
As far as the leave structure of the organisations Act is concerned ,these are driven under the National Holidays Act and Negotiable Instrument Act.The leave encashment can be reffered from Factories Act.
To clear the related concepts i am Attaching a PPT on various Acts.

Thanks Ashok, I think the ppt should help. But, I am still confused. All the acts mentioned refer to industrial workers. Now, we being in the service sector - are teh applibale to us as well?

What a wonderfull handbook of LL, It's really worth it to have it and to know , As far as Service sector is concerned there is no seperate ACT, However it depend whether you registered in Shops &Est Act/Factories Act.

no need to be confused. all our labour acts concern about factories and other manufacturing sectors. but yours is service sector so when you reach 50 + employees you need to be worried about this. and as for as i concern if it is a LTD company they have to implement these statutory requirements. so don't worry. try to practise best HR measures till than.

as for as leave and holidays are concern, all business entities are supposed to give one a holiday in week, it may be any day in a week and
this should be maintained in a employee register or master roll.
and coming to holiday employees must be given a holidays on government recognised holidays otherwise it has to be compensated with any other holidays
