Gratuity from joining date or from gratuity and pf scheme introduction date?
Kindly i need some information about gratuity and pf please help me. one of the employee gratuity and pf has started from june 2013. but he has joined company in 2000. whether that employee can claim gratuity from joining date or from gratuity and pf scheme introduced date.
Gratuity
My date of joining was 06.05.06. after notice period of 1 month i left the job on 30.04.11. after joining they started deducting my pf after 1 year. nothing about pf / gratuity is mentioned in my appointment letter. today i recd. call from hr that you have completed only 4 years so u will not get gratuity. can anyone help in this case ?? for gratuity date of joining is important or p.f deduction ? or gratuity and pf interlinked with each other ?
Reagrding pf and gratuity
Dear all i am new to this forum. i am having confusion with respect to pf and gratuity. i was working in a biotech organization from past 8 years. i went on for maternity leave for 3months and after which i asked for 3 more months which my boss resisted to give. due to this i had to resign from my position. after resigning i served the company for more than 3 months by working from home by fulfilling my responsibilities. now my boss is not agreeing to sign the pf papers saying that i have serve notice period of 1 month. he is insisting me to come personally to get the pf papers signed from him. i had sent the forms earlier through regional pf office. he is not ready to sign pf papers at all without me going to him personally. gratuity also he is holding back and not agreeing to give it off kindly guide how do i go about what shall i do for getting pf and gratuity? do i need to send the gratuity form filled to the office asking for gratuity. i am really confused. please guide me thanks and regards geetha

Dear friends i am sharing you a attachment of a madras high court judement under payment of gratuity act in which the eligibility of an employee to claim gratuity under the payment of gratuity act has been clarified by interpreting the continious service as 4 years and 240 days as minimum elegibility criteria for claiming gratuity.
No pf or gratuity in pay slip
Hi team a small org of about 18 permanent employees and around 20 contract employees. one person s pay is 10 lpa but there is no pf and gratuity components as part of pay. some variable component is there and only 2 deductions pt and tds. the company says that pf is not applicable to them. is it possible that there is no pf and gratuity component in the above scenario? please help resolve my query. thanks
Gratuity calculation
Dear seniors i have a question which you can solve it. my question is one of the staff has left the company and rejoined. as per the law we submitted form 5 and 10 for pf office and got the new pf number. now my question is his gratuity amount has to be cleared. he joined in year 2005 but we have enrolled under the pf act on 01/02/2006. hence i want to know i need to calculate his gratuity from 2005 or from commencement of pf date? i am waiting for your quick response with regards
