Dear Seniors,
Please help me out, I am a bit confused because in an interview, I was asked the difference between Charge Sheet and Show cause Notice. Kindly let me know about the main difference between them and which one comes early and when we can issue showcause notice and when a chargesheet?

Hi Rajesh,

Once you got the information that a particular / Group of employees involved in any indiscipline activity then framing all the charges under the Model / certified standing orders applicable to the organization the charge sheet will be issued asking the individual employee to submit his explanation with in 48 hrs / 2days / 3 days etc., hence the process starts with Charge sheet.

Once the management is not satisfied with the explanation of the employee then they can call for a Domestic enquiry, once the enquiry is completed and the enquiry submitted his findings to the management and basing on the report submitted / finindings of the enquiry officer's the management will issue Show cause notice to the employee mentioning the proposed punishment, even if it is a major / capital punishment the management will issue a second show cause notice also giving more opportunity to the employee. Hence all put together the charge sheet is the begining and followed (if required only) show cause notice.

Sir,
Namaskar to all of you. I am a very new member of this forum. My doubt regarding the difference in between the charge sheet and show cause has not yet been cleared. Which one is to be issued first ?
Should I issue Charge-Sheet before issuing show-cause notice where there is suffficient evidence against an employee ? So far I know
Show-cause notice is issued first then the Charge Sheet and then if necessary the managment will start departmental enquiry ? Is it correct .
Want to know the details of it.

Suspension can be based prima facie evidences. But the reasons for suspension turned out to be insufficient, the suspension shall be revoked with all applicable benefits due to the employees. I think, even during suspension period the employee is eligible for certain portion of his salary/wages.

1. Basically, there is no difference between a Showcase Notice and a Charge Sheet. Both contain the statement(s) of allegation(s), the consequent act(s) of misconduct committed by the employee and directing him to submit a written explanation within a stipulated timeline showing cause why disciplinary action should not be taken against him for the alleged act(s) of misconduct.

2. People generally refer to the document as a show cause notice if it is for a minor act of misconduct and a charge sheet if it is for a major misconduct. But, the format of the two documents is the same viz. statement of allegation(s), consequent act(s) of misconduct committed, submission of written explanation by the employee within a stipulated timeline.

3. Some organizations first issue a show cause notice, get a reply from the employee based on which issue a charge sheet though the contents of the two documents would be much the same. This would only delay the process as in this case, the reply of the employee to the charge sheet issued has again to be obtained before proceeding further.

4. The show cause notice issued by the disciplinary authority after the conclusion of a domestic inquiry and receipt of the report of the inquiry officer is called second show cause notice. In this notice, the delinquent employee is directed to show cause why he should not be dismissed as a measure of punishment for act(s) of misconduct held proved against him in the course of inquiry as per the report of the inquiry officer. The second show cause notice is to be issued only if the organization is proposing to impose the punishment of dismissal against the employee.

4. Suspension are of two kinds. One is called Suspension Pending Inquiry and the other Suspension as a measure of Punishment. Suspension of an employee pending inquiry can be resorted to before issue of charge sheet or along with the charge sheet and even after receiving his reply to the charge sheet, based on his reply & depending on the gravity of the misconduct(s) allegedly committed by him. Normally, suspension pending inquiry is effected either before issue of the charge sheet or along with the charge sheet. Suspension as a measure of punishment is imposed after following the disciplinary process, provided it is listed as a punishment in the Certified Standing Orders of the establishment. If the establishment does not have its certified standing orders, then it has to be listed as a punishment in the Model Standing Orders applicable to the establishment.
