According to section 10 A of Industrial Employment(Standing Orders) Act, 1946
Subsistance Allowance: Where the workman is suspended by pending investigation or employer pending investigation or inquiry into complaints or charges of the misconduct against him, the workman shall be paid the subsistance equal to 50% of wages for first 90 days of suspension and 75 % of wages for remaining period till completion of disciplinary proceedings.

Fully agree with you. There can be State legislations on Payment of Subsistance Allowance. For example in Tami Nadu there is a Tamil Nadu Payment of Subsistance Allowance Act 1981 and in Kerala Payment of Subsistance Allowance Act 1973. Both Acts prescribe payment of subsistance allowance at the rate of 100% after 180 days of suspension pending enquiry.

Vaibhav, Pf treatment will depend on the Basic that he earns. It will be paid commensurate to the Basic paid during the suspension period.

Pf deduction not mandatory during the period ofsuspension, but if the employee desires, then it has to be intimated to the employer in writing to continue his subscription, otherwise the loans if any provided would continue to be deducted & other taxes will also be deducted

Dear All,
The subsistance allowance shall be paid like 50% till 90 days and thereafter 75% of total gross salary. Commensurate with the %age of gross salary, the basis salary would be reduced and accordingly the PF shall be calculated.
It is paid during the period where any inquiry/disciplinary actions are pending.
There are distinct rules and regulations for different states but more of the states follow the same rules.
